Regulatory Alert - Eurasian Customs Union

At the end of 2017, RosAccrediation (Russian Accreditation Authority) and Federal Customs Service of the Russian Federation released updated guidelines listing documentation requirements to be recorded by accredited Customs Union (CU) Certification Bodies for samples provided under CU conformity assessment. The Eurasian Economic Union (EAEU) has aligned its Regulation on the restriction of the use of hazardous substances in electrical and electronic equipment with the EU RoHS legislation. As a result of these new guidelines, stricter sample requirements are now in place.

From now on, both new and renewal CU Approval applications, the sample requirements are as follows:

  • 1 functional sample is required for CU Declaration scheme (previously a paperwork only scheme)
  • 3 functional samples are required for CU Certification scheme (previously only 1 sample was required)

    Please note that the above changes are only applicable if a Russian Certification Body (CB) is used.

    Apart from this, RoHS has restricted substances, and their maximum concentration values tolerated by weight in homogeneous materials, are:

    • lead (0.1%);
    • mercury (0.1%);
    • cadmium (0.01%);
    • hexavalent chromium (0.1%);
    • polybrominated biphenyls (PBBs) (0.1%); and
    • polybrominated diphenyl ethers (PBDEs) (0.1%).

    The legislation applies to products including domestic appliances, IT equipment, telecommunications equipment, lighting equipment, electrical tools, leisure and sports equipment and vending machines.

    The regulation also outlines conditions for compliance, labeling, and operation in the Customs Union market. EAEU member states will have until 1 March 2020 to comply.
