New Regulations for the EU

The UKโ€™s BEIS has confirmed that the EUโ€™s Delegated Regulation (EU) 2019/320 will not apply for Great Britain.

EU law, including the EU Radio Equipment Directive, remains applicable in Northern Ireland by virtue of the Northern Ireland Protocol. The Commission Delegated Regulation (EU) 2019/320, which is made under provisions of the EU Radio Equipment Directive, is directly applicable in all Member States of the EU and applies from 17 March 2022. Therefore, the UK will put in place any measures that may be necessary to give effect to the new Regulation for Northern Ireland by this date. However, the new Regulation will not apply in Great Britain.

BEIS has clarified the fact that an EU delegated regulation is listed on legislation.gov.uk does not necessarily mean that it is EU law applicable in the UK. Along with that, the website serviceโ€™s statutory function extends to listing other legislation with an ongoing interest to the UK (even if not applicable in the UK).
