ARCEP Enforces Stricter Type Approval Criteria for Terminal Devices and Security Compliance

The Regulatory Authority for Electronic Communications (ARCEP) has formally enacted a newly updated implementation Decision, confirming the systematic enforcement of core provisions within its Type Approval Regulations. This framework transitions the regulatory landscape away from purely document-based evaluations toward a hands-on compliance model. The updated mandate establishes strict benchmarks intended to reinforce national network integrity and guarantee hardware safety.

The updated guidelines dictate strict and systematic evaluation across three critical focal areas. First, hardware manufacturers must fulfill enhanced product sample submission requirements, meaning that terminal devices must be provided to the regulator for physical evaluation and technical testing. Second, applicants must supply a clear demonstration of data protection and information security obligations, establishing a verified baseline of data protection and firmware resilience before market access is permitted. Finally, devices must explicitly comply with mandatory type-approval labeling rules, ensuring consumer clarity via proper marking placement.

ARCEP clarified that these updated compliance pillars apply uniformly, leaving no room for legacy omissions. The criteria govern both newly submitted type approval applications and certifications that are actively under review. Consequently, all original equipment manufacturers (OEMs) and regulatory applicants must immediately audit their active registration portfolios and align their technical dossiers with the updated framework to prevent processing delays or application rejections.
