Kenya CA Strengthens Telecommunications Type Approval Oversight and Distributor Licensing Requirements

The Communications Authority of Kenya (CA) has intensified post-market surveillance and administrative enforcement surrounding the importation and commercial distribution of ICT, telecommunications, and radio frequency hardware.Beyond addressing temporary administrative lead times and backlogs stemming from Nairobi-area civil disruptions, the regulator has restructured its market access framework to streamline customs clearance and tackle non-compliant customer-premises equipment (CPE): such as substandard routers, access points, and cellular modems, entering domestic supply chains.

Under the updated regulatory structure enacted via Gazette Notice No. 3335, the CA introduced a mandatory Communications Equipment Distributor (CED) license requirement. Importers, wholesalers, and suppliers must secure a valid CED license before their equipment can obtain formal type approval or clear customs through the National Electronic Window System (Trade Facilitation Platform). Furthermore, import permit applications submitted on the platform must feature explicit compliance documentation, including invoice-level model verification, proof of IPv6 protocol support for internet-connected hardware, and technical construction files backed by test reports from accredited facilities.

To safeguard spectrum integrity and consumer protection, the CA reaffirmed that type approval obligations apply universally across Short Range Devices (SRDs), Wi-Fi equipment, satellite terminals, and cellular mobile devices. In addition, the authority underscored that compliance extends beyond initial certificate issuance, warning that equipment failing to maintain ongoing technical and safety standards in the field remains subject to product seizures, administrative fines, and certificate revocations. Hardware manufacturers and local distributors targeting Kenya must align their supply chain logistics with these heightened licensing controls and verification steps to ensure uninterrupted market access.
